Terms and Conditions

1. Subject of performance
1.1 Pascal Schaller Personal Training (hereinafter PSPT) undertakes to offer the customer targeted and individual training and health care.

1.2 If no other agreement has been made, the training and health care can only be used by the client personally.

1.3 The agreed training and support service is a contractual agreement within the meaning of the Swiss Code of Obligations.

2. Training and therapy
2.1 The duration of a training session is 60 minutes, unless otherwise agreed.

2.2 The type, scope, goals and location of each unit will be discussed or requested with the customer.

3. Liability
3.1 PSPT provides the agreed service with the necessary care and is liable for damage to the customer insofar as it is directly caused by a proven intentional or grossly negligent breach of contractual obligations or other duties of care by PSPT. To the extent permitted by law, any further liability arising from the contract or any other legal basis is expressly excluded.

3.2 PSPT is not liable beyond the provision of the service owed for any non-achievement of the purpose pursued by the customer when entering into the contract.

3.3 If the customer uses the services of other companies or persons, he does so at his own risk. PSPT assumes no liability or warranty for goods or services that the customer has received from them.

3.4 The customer is responsible for insuring himself against accidents and injuries that may occur during the training. The same applies to the direct route to and from the training location.

4. Terms of Payment
4.1 The booked training units are invoiced in advance. The amount owed must be paid in cash or by bank transfer within 10 days of invoicing.

4.2. The price plan includes training and coaching with the personal trainer. Any expenses and additional costs are part of the agreement on expenses and additional costs.

4.2 The current price list applies. PSPT reserves the right to change pricing. Current agreements are not affected by this, however.

5. Other Costs
5.1 If additional costs arise due to the service requested by the customer (entrance fees, space rental, flights, etc.), these are to be borne by the customer.

5.2 If the training location is within ten kilometers by car of Zug, unless otherwise agreed with the customer, a kilometer flat rate of CHF 0.60 per kilometer driven will be charged. In addition, the travel time can be charged. However, this is agreed with the customer in advance.

5.3 The customer bears the costs for a doctor, physiotherapist, nutritionist or similar who is consulted for further care.

5.4 If PSPT provides other training or services (e.g. training support when travelling, etc.), separate tariffs will be agreed in advance.

5.5 If PSPT buys products (sports goods, etc.) on behalf of the customer, the goods remain the property of PSPT until full payment has been made.

6. Delay, Inability or Cancellation
6.1 The contracting party reserves the right to postpone training dates with timely advance notice.

6.2 If the customer is prevented from attending, he/she must cancel as soon as possible, but no later than 48 hours before the start of the training. Appointments canceled later can be charged in full. This does not apply to accidents or death in the family.

6.3 If a training session is delayed, too dangerous or impossible due to unforeseeable circumstances (weather conditions, etc.), the training session will be postponed after consultation. The decision is always made in mutual agreement with the customer. If the delay is self-inflicted, the booked training time cannot be extended.

6.4 In the case of group training, any postponements of dates automatically apply to all training or coaching participants.

7. Claims for Compensation
7.1 In the event of a training cancellation by PSPT, no claims for compensation can be asserted. Training units that have already been paid for will be credited or reimbursed on request.

8. Privacy and Confidentiality
8.1 The personal data of the customer are used by PSPT exclusively to fulfill the aforementioned service. Excluded from this are the before and after pictures, which can be used anonymously for advertising purposes after customer consultation.

8.2 PSPT shall maintain secrecy about all customer information that has become known in connection with the fulfillment of the training and support measures, even beyond the termination of the contractual relationship.

9. Other Agreements
9.1 Both parties recognize arrangements and agreements on the booking of services as binding if they have been confirmed by both parties. This applies to all means of communication used, including telephone or e-mail.

9.2 Both parties agree to mutual loyalty and will in no case speak negatively of the person, products or services of the other or damage their reputation and prestige.

Terms of Contract

1. Subject of performance
The training agreement is concluded between the signing customer or his/her legal representative and Pascal Schaller Personal Training (PSPT). PSPT can use a cooperation trainer after mutual agreement and corresponding contractual regulations.

2. The undersigned
The undersigned confirms that they have read, understood and accepted the following conditions. The contract becomes valid through the counter-writing of the contracting party. The signing takes place after the completion of the trial training or by agreement. Changes of address must be communicated to the contracting party.

3. Term of Subscription
The term of the subscription ends with the last training session and must be renewed, if desired, by means of a new training agreement or a renewal form with renewed countersignature. If the paid training hours are not redeemed, the subscription and thus the entitlement to the service expires two years after signing the training contract or the renewal form, unless the contract holder submits a credibly justified and written request for an extension of the term. The invoice amount will not be refunded.

4. Invoice Amount
The respective invoice amount is to be paid immediately after invoicing. Training and coaching with the personal trainer are included in the price plan. Any expenses and additional costs are part of the expenses and additional costs agreement integrated in this document.

5. Postponement
The contracting party reserves the right to postpone training dates with timely advance notice. The contract holder can cancel already agreed training dates free of charge up to 48 hours before the start of the training or by agreement. Appointments canceled later can be charged in full. In the case of group training, any possible postponements apply automatically to all training or coaching participants.

6. Cancellation
In the event of illness, accident or force majeure, an appointment can be postponed at short notice. The contractor must be able to provide credible evidence of the special reasons mentioned.

7. Insurance
Insurance is the responsibility of the contract holder. The contract holder confirms that he/she is adequately insured against the consequences of accident and illness. The contracting party expressly rejects any liability for any damage that the contracting party incurs as a result of an accident or illness during training. The contract holder confirms that he/she is fit for sport.

8. Liability
The contracting party assumes no liability for stolen or lost items. The respective house or site rules apply at the training locations.

9. Price Changes
PSPT expressly reserves the right to make any price adjustments and contract changes. Corresponding changes will be communicated in writing in good time before they come into effect.

​

 

10. Jurisdiction
All legal relationships between the contracting party and the contractor are subject to Swiss law. The place of jurisdiction is Zug.
